The district consumer disputes redressal commission (DCDRC) is a benevolent social law that sets out consumers ‘ rights and guarantees that they are promoted and covered by their rights. The first and only act in India has allowed ordinary consumers to ensure that their problems are remedied with a less expensive and frequent redressal option. The law makes the dictation of Caveat Emptor (“Buyer Beware’) a thing of the past, by specifying the rights of and solutions that customers in a market historically exercised over by organized producers and traders of products and service providers.
This Act refers to all “goods” and “services.” The goods are those produced or produced and sold by wholesalers and distributors to consumers. The services cover transport, electricity, telecommunications, accommodation, banks, insurance, healthcare, etc.
A written complaint may be submitted in respect of products defects or faulty service to the District Consumer Commission for the financial value for upto Rupees One Crore, to the State Commission upto Rupees Ten crores, and to the National Commission above Rupees Teh crores, as per the New Consumer Protection Act, 2019, brought into force w.e.f. 20th July, 2020. The service can be described and the above illustrations are indicative only. However, a deficiency claimed in any service that is made free of charge or under a Personal Service Contract shall not be subject to appeal.
